Can a tenant who does not pay rent be evicted? How long will it take to evict a tenant?

Eviction can only occur if the tenant breaches the contract or meets specific grounds under Section 8. For rent arrears, landlords can rely on Mandatory Ground 8 or Discretionary Grounds 10 & 11. Crucially, under the new Act, to use Ground 8 the tenant must be in at least 3 months' arrears (increased from 2 months) at the time of service and hearing.
